What can I do about my builder not finishing the punch list and warranty items on my house, besides taking him to court?

We have more than 40 items still left on our punch list and warranty list that [the builder] refuses to finish along with some very big ticket items like damage to our marble.

First go to the postoffice to send your list in a registered letter by certified mail to the builder owner (the letter will have to be signed for, along with the date received & you will be mailed the receipt). In the letter, threaten legal action and ask for a written response within 10 business days. This will get attention for you! Keep a copy of this letter, of course, start writing summaries of every verbal promise made to you and mail them to the owner. This will start a written record that could be used later in court. This will get their attention!
